The Casa del Rey board has been working with a law firm for several years to update the articles of incorporation for our homeowner’s association, the bylaws, and the covenants, conditions, and and restrictions which together form the governing documents for our association. When each of us purchased our homes, you received a copy of these, and if you’ve ever looked at them you probably saw that they were photocopies of photocopies of the original documents which the developer of our association filed with the state of California back in 1977 when our complex was built.
In the forty five years or so since these were written, the law and rules for home owner’s associations have been changed by the state multiple times, which means there are parts of our bylaws that are no longer in effect because state or local law has superseded them, and there are parts which are just out of date because things have changed over time. It is a best practice for associations to periodically review and update their governing documents, and that is what we have been doing. On the website page below are a few PDFs of what we will be sending out to ask the association to vote to adopt to replace our existing documents with this up-to-date version.
We have tried, as much as possible, to retain the original meaning and intention of these, merely updating them to be current and clear. Immediately behind this letter is a several page summary from the law firm which we engaged to do this work, detailing the changes. Â
At the annual meeting, which we will likely conduct late this spring virtually because of the ongoing COVID situation in the county, we will be asking to approve adopting this. Before then, we’d like everyone to have time to look through these and send any questions to the board, which we’ll try to answer or have the lawyers address. If there are enough owners with substantive questions we can schedule a video conference for anyone interested where they can talk directly with the lawyers who have done this rewrite.
